A Queensland solicitor reviews every file

This is not a do-it-yourself kit. Our Queensland solicitor assesses your documents and approves them. Your saved card is charged only on approval, and we then email you an unlock key so you can print your documents.

Then you sign in “wet ink” in the presence of your witnesses.

Wet-ink signatures required. A Queensland Will, Enduring Power of Attorney and Advance Health Directive are not executed or valid until you print them and sign in wet ink as the law requires. Each document has its own validation requirements — see the documents page. A draft, digital signature or email is not enough. You arrange those wet-ink signatures yourself after you unlock and print.

Estate bundle — advantages and considerations

Advantages

  • A Queensland solicitor reviews the file before any unlock key is sent — this is not a DIY kit.
  • One set of names, addresses and ID instead of three separate forms.
  • Lifetime and death documents are consistent with each other.
  • Bundle price is less than buying the three programs apart.

Considerations

  • You still sign three documents, each with its own witnessing (and a doctor for the AHD).
  • Blended families, businesses, overseas assets or a family member with disability may need extra advice after review.
  • Attorneys, executors and health decision-makers do not have to be the same people — think through each role.
  • Instructions only: nothing is a valid legal document until it is signed as Queensland law requires.

Things you will need before you get started

Gather these first and the forms take about 20–30 minutes. You can save your answers to a file and come back later.

Will

  • Photo ID A photograph of your driver licence or passport (you can use your phone camera).
  • Your details Full legal name, residential address, date of birth, phone and email.
  • Two executors/trustees Names, relationship, address and phone or email for your Will.
  • Beneficiaries Names, relationship to you, and share totals that equal 100%.
  • Two independent witnesses Names, street, suburb, state and postcode. They must be adults who are not beneficiaries and not the spouse of a beneficiary.
  • Significant assets A list of your main assets: property, bank accounts, shares, vehicles, superannuation and life insurance (and any nominations already made).

Enduring Power of Attorney

  • Photo ID A photograph of your driver licence or passport (you can use your phone camera).
  • Your details Full legal name, residential address, date of birth, phone and email.
  • Attorneys Up to four people for your EPOA/AHD — full name, address, phone and email. Attorneys 1 and 2 are suggested as health decision-makers.

Advance Health Directive

  • Photo ID A photograph of your driver licence or passport (you can use your phone camera).
  • Your details Full legal name, residential address, date of birth, phone and email.
  • Attorneys Up to four people for your EPOA/AHD — full name, address, phone and email. Attorneys 1 and 2 are suggested as health decision-makers.
  • Health wishes Your views on CPR, ventilation, tube feeding, blood transfusions and what matters to you near the end of life.
  • Doctor’s details Name, practice and phone for your GP, who completes the medical section of the Advance Health Directive.

Will instructions

$149.00

A Will records your executors, gifts, residue shares and funeral wishes. In Queensland it is not valid until it is in writing and you sign it in the presence of two independent adult witnesses, who then sign in your presence.

Advantages

  • You choose who administers the estate and who receives it.
  • You can leave specific gifts and split the remainder in percentages that add to 100%.
  • Funeral wishes and substitute executors can be written in, so family are not guessing.
  • A current Will usually reduces delay, dispute and applications to the court.

Considerations

  • It has no effect until it is signed as the Succession Act 1981 (Qld) requires.
  • Superannuation, life insurance and jointly owned property often pass outside the Will.
  • Marriage, divorce, new children or a move interstate can mean the Will needs a review.
  • Witnesses should be adults who are not beneficiaries and not the spouse of a beneficiary.

Enduring Power of Attorney

An Enduring Power of Attorney (EPOA) appoints people you trust to make financial and/or personal and health decisions if you lose capacity. Financial powers can start immediately or only if you become incapable. The appointment ends when you die — your Will then takes over.

Advantages

  • You choose your attorneys while you still can, instead of leaving it to QCAT later.
  • You can split financial and personal powers, set limits, and say whether attorneys act jointly or one after another.
  • It lets bills, banking, housing and care decisions continue if you are in hospital or lose capacity.
  • Paired with a Will, it covers lifetime decisions the Will cannot.

Considerations

  • It is a powerful document. Attorneys must act honestly and in your interests, but you should only appoint people you trust.
  • It must be signed and witnessed as the Powers of Attorney Act 1998 (Qld) requires.
  • Joint attorneys must agree; jointly and severally means one can act alone — pick the option that matches your people.
  • An EPOA does not dispose of your estate on death. You still need a Will for that.

Advance Health Directive

$79.00

An Advance Health Directive (AHD) is your written record of health-care values and the treatments you would, or would not, want if you cannot speak for yourself. In Queensland a doctor completes part of the form. It works alongside an EPOA for personal and health matters.

Advantages

  • Doctors, family and attorneys have a clear record of your views on CPR, ventilation, artificial nutrition and other treatment.
  • It can reduce conflict in a crisis when people disagree about ‘what they would have wanted’.
  • You can name values and limits in your own words, not only tick-boxes.
  • It guides the people appointed under your EPOA rather than replacing them.

Considerations

  • A Queensland AHD is not finished until the medical practitioner’s section is completed.
  • Talk it through with your GP before you lock in CPR or life-support choices.
  • Keep copies with your GP, hospital, attorneys and at home — a directive no one can find cannot be followed.
  • It is not an EPOA. It does not let someone manage money or sign contracts for you.
